I love so many instructors (so many I wont even begin to mention) people, EC's, operation managers, staff and genuinely amazing leaders and co-workers. I have not met an instructor I did not love, everyone in Westwood makes my heart melt, The amazing ED who hired me is incredible and every franchise owner I've met is incredible, I love Mark Patrick, he Is a beacon of love and light and they too I believe have been victimized, HR has gone above and beyond and Anita is truly amazing, the following actions are not a reflection of her or anything the HR team could of done, It's the few people they are working with that are the problem. I also love the social media team and I'm sorry for all the extra work I'm causing you. Im sorry for those whom i love I know are reading this, I Love Gene, the COO so much as well and I'm sorry you have to read this from me, as well as John O'Donnell and Many others. I've personally not had a bad interaction with Eyal so I cannot speak to his role in this although I've heard allegations, although surely there comes a point where priorities and people should be questioned. This in my opinion has all been orchestrated and enabled by a small handful of people or less. I Love my previous managers Dave, Andy and Randy, I love Merlin he is a beacon of knowledge and hope... Jake was the inception of all my OTA Challenges that have transpired in the following statements of my account and perceived opinion, and allegedly from what I understand Aaron Nielsen, Larry Jacobson, Steve Albin are the culprits and systemic enablers of everything that happened, continues to happen with no signs of stopping but I could be wrong, I am particularly concerned about one thing, for as long as I've known, Aaron Nielsen has been acting as the head of sales to everyone from the remote team to EC's and ED's since at least 2017 as well as CFO and Interm HR, and I imagine managing the finances of the other companies under the NE Holding umbrella, I'm not sure how he escaped the narrative, and my further sympathies for franchise owners, allegedly even in the way non yet buyers are recorded and process from what I remember for no other reason than number padding presumably for franchise owners by instructions of Aaron, but I could be wrong but I do remember this being a thing talked about, I presume I could be wrong and I have no concrete evidence for this so I'll leave that as an open question and someone may know more about this.
As much as it breaks my heart, After taking all of the proper channels and working endlessly to be accommodating, cooperative, kind and resolving all of this internally for years, I've been left with no choice but to file an OSHA complaint for reporting my concerns (internally and thus now therefore now likely formally, FTC, SEC, IRS, FBI, EEOC, OSHA, DFEH) and being blacklisted for it and the EEOC as it is too hard now to tell why it is exactly I was never approved or interviewed, especially in light of recent events, as well as the Internal Revenue Service (IRS) regarding the true validity of the "Independent Contractor" status of many presenters, Instructors and others who work over 40H and are not allowed to compete.
It also seems very clear the reason this countersuit is happening in the 7th circuit is so no reparations have to be paid to anyone including students, franchise owners or employees from the plaintiff's personal assets due to Section 13b getting away with keeping all money made from the faulty education that is continued to be pushed today headed by Larry Jacobson and Steve Albin, I could be wrong in which case it would be presumably easy to verify with a subpoena into their personal trading statements are the ones leading the education. It breaks my heart for the franchise owners as I almost feel they got as much taken advantage of as students did. I don't see how moving the case to the 7th circuit benefits any student, employee or franchise owner in which case if you agree it might be worthwhile to contact the circuit, Attorney General etc. and proper channels to send the case back to CA which is also its proper jurisdiction. Although considering it seems Sam has been framed to have roles he never did and framed out of context it seems worthwhile to consider if these are actually not OTA lawyers but rather private parties and wether that should pierce the corporate vail anywhere anyways and or wether any OTA legal insurance should be revoked or wether it could be insurance fraud if applicable as the most notable culprits across the board culprits are not mentioned such as Aaron Neilson, again acting CFO, Managing sales officially or unofficially (Which any EC and Company Owned ED's can attest for) as well as Larry Jacobson, Head of instructors, Steve Albin and Gaylene Galliford (The actual managers of core strategy depicted today and now for a long time as well as listed on the Patent with NE Holdings as the assignee, who has assigned Steve and Larry to be in change of it now for a long time) but presumable scapegoats with faulty past job descriptions such as Sam Seiden are, who have continuously verbalized wholehearted disapproval, but I digress...
In addition to now looking into and wondering whether Criminal Misrepresentation charges are applicable in light of the latest release by the as listed as they all seem to apply Particularly in the actions and allegations made and let by Darren Kimoto to the entire network of MTO instructors to which students, Myself included bought under the presumption instructors and presenters were profitable and must prove to being such "every fiscal Quarter to be active as such" Criminal Misrepresentation;

(1)Any claimant or representative of a claimant who knowingly and willfully makes a false statement or representation for the purpose of obtaining a benefit or payment under this chapter shall be guilty of a felony, and on conviction thereof, by imprisonment not to exceed five years, or by both..
-Misrepresentation of a material fact
-Knowledge on the part of the accused that they were misrepresenting the fact
-The misrepresentation was made purposefully, with the intent of fooling the victim
-The victim believed the misrepresentation and relied upon it
-The victim suffered damages as a result of the misrepresentation
It breaks my heart it had to come to this, I Love the HR Department and the entire Family. I know they've done everything they can to remedy the situation, but it is not their doing, this has been the doing of a few (In my Opinion) who are allowed to continue to pay some minorities less, block good talent for personal or discriminatory reasons and/or likely both, I don't know anymore, but if you feel you have been a victim of any of this it is reasonable to file now. There are so many amazing, talented and beautiful souls that have done nothing but offer incredible support, who are very ethical, kind, loving and compassionate and to you my heart goes out. To move forward to a better future we must amend the past, and those who do not apologize for the past are bound to repeat it. I have tried everything to help everyone and make this a great place for everyone, I honestly do not know what to believe to be true anymore and therefore feel I've had no choice but get the agencies involved, I gave it until the very last day I could file many of these concerns in efforts to try to resolve this up to the very last minute...I guess the FTC did too... This isn't a me problem, or an HR one, Or an individual Instructors or EC problem, or OTA IMO, It's a grossly egregious leadership problem. My heart also goes out to Franchise Owners who are just victims in the situation and so many truly amazing people that have been affected by the awful leadership and their incessant actions despite many reports by people trying to fix this in good faith without affecting structure or sales but they continued none the less, knowing, able and willingly.
Between the Loss income after Jake Bryant forced my resignation for what I later found out to be discrimination and coming back total to being over 50,000 USD's the Faulty Education 25,000 USDs, in Bad Trades while ""Learning from them at least 25,000USDs In Seemingly Discriminatory loss promotions another at least 50,000 USDs and becoming a great trader on my own will and accord at least another 100K in liquidating my trades to take their advise from the deceptions and still trying to believe in what they knew to be false. I've tried everything I could to get in and fix this in good faith by what I independently learned to no avail as I loved them like family but It's clear there is no attempt in actually fixing any underlying problems.
Whistleblower protection extends to future employment as well, as employees may not be retaliated against by future employers for performing the protected activities listed above in an earlier employment situation. Cal. Lab. Code § 1102.5.
